As of September 2024, the social media platform X, formerly known as Twitter, has been banned in Brazil following a contentious legal battle between the platform’s owner, Elon Musk, and Brazilian Supreme Court Justice Alexandre de Moraes. This ban has sparked significant controversy and discussion both within Brazil and internationally.
The primary reason for the ban stems from X‘s refusal to comply with Brazilian legal requirements, particularly regarding the appointment of a local legal representative. Brazilian law mandates that international companies operating within the country must have a legal representative to ensure accountability, particularly in matters involving content moderation and misinformation. When Musk removed X’s legal representative in August 2024 and failed to appoint a new one, Justice de Moraes ordered a nationwide ban on the platform, citing non-compliance with court orders as well as concerns over the platform’s role in spreading misinformation.
The situation escalated when X, under Musk’s direction, openly defied court orders related to the moderation of content, especially those deemed harmful or false, which led to tensions between the company and the Brazilian judiciary.
